Terms and Conditions

These terms and conditions were last updated on 18 August 2026 and replace all previous versions. This translation is provided for information only; in case of discrepancies, the Dutch version prevails.

1. Definitions

• Lessor: DR-Booth, Retersbekerweg 58, 6343 PL Klimmen, the Netherlands.
• Lessee: the party renting a photo booth for an event.
• Photo booth: the photo column supplied by the lessor, with camera, printer and associated equipment.

2. General

• These terms apply to all quotes, agreements and services of the lessor.
• By entering into an agreement, the lessee agrees to these terms.
• Deviations are only valid if agreed in writing.
• If the lessee is a consumer, the mandatory provisions of Dutch consumer law continue to apply in full. Where a provision of these terms conflicts with them, the statutory rule applies.

3. Quotes and formation of the agreement

• Quotes from the lessor are non-binding and valid for 30 days.
• An agreement is formed when the lessee accepts the quote verbally or in writing and the lessor has confirmed it.
• The lessor reserves the right to refuse assignments without giving reasons.

4. Prices and travel costs

• All prices stated are all-in and include VAT, and cover the photo booth, the prints as stated in the chosen package, the personalised design, setup and takedown, and on-site support.
• Travel costs are included within a 40-kilometre radius of Klimmen.
• If the venue is further away, a travel surcharge applies to the extra kilometres. These extra kilometres are driven four times (there and back for setup, there and back for collection) and are charged at €0.35 per kilometre:
  surcharge = (one-way distance in km − 40) × 4 × €0.35
• The surcharge is always shown as a separate line in the quote, so it is clear in advance what will be charged.

5. Reservation, deposit and payment

• A deposit of €100 is due on reservation. This confirms the date.
• The deposit is deducted from the total amount and is non-refundable, except as provided in article 6 and article 11.
• The balance must be paid no later than 7 days before the event, unless otherwise agreed in writing. Cash payment on the day itself is possible if agreed in advance.
• If payment is not made on time, the lessor is entitled to cancel the reservation. Amounts already paid will in that case be offset against the cancellation costs under article 6.
• In case of non-payment, the lessee owes statutory interest and, after a reminder, extrajudicial collection costs in accordance with the statutory scale.

6. Cancellation and changes by the lessee

• Cancellations must be made in writing, by email to hello@dr-booth.nl.
• For cancellations more than 14 days before the event, 25% of the rental price is due.
• For cancellations 14 days or less before the event, 50% of the rental price is due.
• In both cases the cancellation costs amount to at least the €100 deposit. The deposit is offset against the cancellation costs; anything the lessee has paid in excess of the cancellation costs is refunded within 14 days.
• Changes to the date, times or package can be made free of charge up to 14 days before the event, provided they are confirmed in writing and the new date is available. Within 14 days, extra costs may be charged.

7. Delivery and installation

• The lessor takes care of delivery, setup, support and takedown at the agreed venue, and is usually on site well over 60 minutes before the start to set up.
• The lessee provides a suitable space of at least 3 by 3 metres and a power socket within 10 metres of the setup location.
• For an outdoor setup, the lessee provides a firm spot protected from rain and wind.
• Damage to the venue caused by the lessor will be compensated, provided it is reported immediately.
• The lessor is not liable for delays caused by circumstances beyond its control, such as traffic or the venue not being available on time.

8. Use of the photo booth

• The lessee is responsible for correct use of the photo booth by themselves and their guests.
• Damage or loss due to careless use is at the lessee's expense.
• The photo booth may not be moved without the lessor's permission.
• Damage must be reported within 7 days after the event.

9. Liability

• The lessor is only liable for direct damage resulting from an attributable failure, and its liability is limited to the amount the lessee paid for the assignment concerned.
• Liability for indirect damage, including lost profits and missed savings, is excluded.
• These limitations do not apply in case of intent or deliberate recklessness on the part of the lessor, nor to damage resulting from death or personal injury. Such liability is neither excluded nor limited.

10. Complaints

• Complaints about the service must be reported in writing to hello@dr-booth.nl within a reasonable time, and in any case within 14 days after the event.
• The lessor will respond to a complaint in substance within 14 days.

11. Force majeure

• Force majeure means any circumstance beyond the lessor's control as a result of which performance cannot reasonably be required, such as serious technical failure, illness, accident, natural disasters or government measures.
• In case of force majeure, the lessor will contact the lessee immediately and, where possible, offer an alternative solution or a new date.
• If the agreement cannot go ahead, all amounts already paid for services not delivered, including the deposit, will be refunded within 14 days. In that case the lessor owes no further compensation.

12. Privacy and data protection

• The lessor processes personal data in accordance with the GDPR.
• Personal data is used solely for the performance of the agreement and is not shared with third parties without consent.
• Photos taken during the event are shared with the lessee via an online album and deleted from the lessor's systems after 90 days, unless otherwise agreed.
• The lessee has the right to access, correct and delete their data. Such a request can be made by email.

13. Photo files and use of images

• The lessee receives the photos digitally, in principle within 5 working days and no later than 14 days after the event.
• The lessor only uses photos from the event for promotional purposes with the lessee's prior consent.
• Even with that consent, the lessor does not publish photos in which guests are recognisable without their consent. The lessee informs their guests about this; on request, the lessor shows a consent question in the photo booth.
• Consent once given can be withdrawn at any time. The lessor will then remove the images concerned from its own channels as soon as possible.

14. Applicable law and disputes

• All agreements are governed by Dutch law.
• Disputes are submitted to the competent court in the district where the lessor is established. If the lessee is a consumer, they have the right, for one month after the lessor has invoked this provision in writing, to choose the court that is competent by law.
